Real Housewives of Salt Lake City star heather gay A confidential settlement was reached after a legal battle involving Beauty Lab.
Photographer Gavin O’Neill sued Heather and her company, Beauty Lab and Laser, for using her photos without permission. He accused Heather and her business of copyright infringement.
But now the spa’s owner and O’Neill have informed the court that they have reached an agreement. In light of their agreement, the photographer decided to drop her claim against her company. No further details were disclosed.
Photo used without permission
O’Neill, a professional photographer, makes a living by licensing his photos to third parties. He has worked with notable magazines such as Vogue, Cosmopolitan, and GQ.
According to RadarOnline, the photographer accused Heather of using several of his photos in an advertisement for Beauty Lab without his permission. He even claimed that one of his images was used to show “what can be achieved with his HydraFacial service at Beauty Lab” and urged users to book online.
Let’s be real, doesn’t everyone know that you can’t use professional photos without permission?
The original complaint alleges that “O’Neill does not permit Defendants (including its employees, agents, contractors, or any other persons over whom Defendant has responsibility and control) to use, display, publish or otherwise use O’Neill’s original and public documents. I have been informed that it is open to the public, and I believe it.” Our aim is to provide unique photographs in order to derive a direct economic benefit from the use of the photographs through revenue from the sale of Beauty Lab’s products and services. ”
Mr. O’Neal sought more than $450,000 in damages, saying he tried to resolve the dispute with Heather before filing suit. Heather’s lawyer denied that she did anything wrong, and she maintained that her photographer was not harmed.
“Defendant’s infringement was unintentional,” her filing said. “Upon receiving the notice, Defendant removed the allegedly infringing photos.”
Now, O’Neal and the owners of Beauty Lab have agreed to drop the lawsuit, but the details of the deal remain private.
Monica’s lawsuit was dismissed
News of this settlement was announced following the dismissal of Monica Garcia’s lawsuit against Heather and her business. Monica claimed in her lawsuit that Beauty Lab “botched” her nose and lip injections. A judge dismissed her case because the statute of limitations had passed.
Monica’s lawsuit was likely motivated by retaliation. She filed the lawsuit after Heather sued her for failing to pay her thousands of dollars for work provided to her beauty lab.
The Real Housewives of Salt Lake City is now streaming on Peacock.
